We, Angkasa Bumijaya SDN BHD (Company No.: 1011897-H) our subsidiaries and associate companies (collectively, “Angkasa Bumijaya” or “The Company”) respect your right to privacy and we respect all Personal Information you provide to us.

We are committed to protecting all Personal Information kept by us. Angkasa BUmijaya is bound by the Personal Data Protection Act 2010 (“PDP Act”) and all other applicable law in Malaysia in respect of privacy protection which set out a number of principles concerning Personal Information and consumer protection in Malaysia.

For the purpose of this Privacy Policy:

“Authorised Third Parties” means Angkasa Bumijaya’s bankers, professional advisors, agents, consultants, contractors, agents or third party suppliers or service providers with whom Angkasa Bumijaya enters into an agreement;

“Angkasa Bumijaya”, “we”, “us” or “our” means collectively, Angkasa Bumijaya Berhad, a company incorporated in Malaysia and having its registered office at Suite 12-05, 12th Floor, Wisma Zelan No.1, Jalan Tasik Permaisuri 2 Bandar Tun Razak, Cheras
56000 Kuala Lumpur, its subsidiaries and associate companies;

“Personal Information” means any personal information relating to you that you have provided to Angkasa Bumijaya or made available to Angkasa Bumijaya;

“Sensitive Personal Information” comprises information as to your physical or mental health or condition, political opinions, religious beliefs or other beliefs of a similar nature, commission or alleged commission of any offence, or any other Personal Information designated as such; and

“Services” comprises any communications, information or other products or services provided by Angkasa Bumijaya to you.

A. Information Collected

The Personal Data about you may include information such as your photograph, name, contact details, address, national registration identity card number or passport number, gender, race, nationality, ethnic origin, occupation or profession, employer’s details, date of birth, email address, marital status, children’s details, age, income, salutation, sociological and/or lifestyle data including but not limited to car registration details, introducer’s details, property details and loan details.

Your Personal Data are collected from various sources including but not limited to:

information or comments or messages you have provided to us by whatsoever means and/or in whatever manner;
information input submitted to online facilities such as search tools and calculators;
information from third parties including referral; and
information obtained independently by us from other lawful sources.

B. Purpose of Collection of Personal Data

By providing any of your Personal Data to the Company you hereby agree that the Company shall collect, retain and use your Personal Data for the following purposes:

carrying out and/or discharging our contractual obligations including but not limited to delivery of vacant possession, key handover, property/estate management, customer care, defect rectification works, club house services, security and customer loyalty programmes; and/or
providing you with services, products or benefits offered by the Company or by selected third parties that we think may be of interest you; and/or
processing your application; and/or
where relevant, marketing of products and services and sending any updates, new products, special offers, advertising, promotional material and/or commercial material to you, processing invoices and payments (including card payments); and/or
conducting research on planning, product, goods, services, security and testing; and/or
carrying out matching procedure in accordance with the law; and/or
performing statistical and benchmarking analysis; and/or
purposes connected with the operation, administration, management, development, record-keeping, contractual enforcement of the transaction and communication with you ; and/or
where required by law, where the Company consider that such use or disclosure is necessary to respond to any claims or legal process, or where the Company suspects that fraud or unlawful activity has been, is being or may be engaged in; and/or
where a third party acquires or wishes to acquire, or makes inquiries in relation to acquiring, an interest in any company within the Company; and/or
where a service and product provider, requires in order for such service and product provider to perform functions, obligations or services as required by the Company or under the laws, rules, regulations, by-laws and/or guidelines (whether or not having the force of laws) or as required by any governmental and/or non-governmental authorities, agencies or departments or a third party requires in order to ensure compliance with agreement(s) or document(s); and/or
for purposes of preparation and submission of any claims or payments to any party or for any audit/checks by any party for whatever purpose related to the Company’s business; and/or
purposes connected with the enforcement of the Company’s rights pursuant to any letter, agreement and/or document including seeking legal and financial advice, taking any preliminary steps or commencing any legal action; and/or
making such disclosures as may be required for any of the above purposes or by law; and/or
for any other purposes that is incidental or ancillary or in furtherance to the Company’s purposes.
We may either contact you for the purpose as set out in (B) above via telephone calls, emails, text messaging, post, facsimile, social media or by whatsoever form of available communication.

C. Use and Disclosure

You have the right to request access to and if required, correction of your Personal Data in our records. You have the right to:

request access to your Personal Data in our records for verification purposes. You may access and review all of your Personal Data held by us in person at our corporate offices located at the address given in (h) below;
request the correction of your Personal Data in our records in the event the information is inaccurate, misleading, out-of-date or incomplete upon validation and verification of the new information provided in person at our corporate offices located at the address given in (h) below;
request that your Personal Data shall only be kept for the fulfillment of the purpose of the collection of such information;
request for proof of policy and procedure in relation to the safeguard and guarantee of your Personal Data in our records;
request that we specify or explain its policies and procedures in relation to data and types of Personal Data handled by us;
communicate to us your objection to the use of your Personal Data for marketing purposes whereupon we will not use your Personal Data for these purposes in person at our corporate offices located at the address given in (h) below; and
withdraw, in full or in part, your consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period in person at our corporate offices located at the address given in (h) below;.

D. Choices to Limit Processing of Personal Data

The Personal Data provided to us undergoes processing as and when required or upon scheduled maintenance. The definition of processing defines it as “any operation or set of operations which is performed upon Personal Data, whether or not by automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction;”

You have the right to limit in part or wholly any of the processes by which your data is subjected to in terms of the operations allowed to be performed upon it, the period of time allowed or alternatively the date line of the consent given.

The responsibility for compliance rests on the shoulders of Angkasa Bumijaya who determines the purposes and means of the processing of Personal Data.

You may at any time withdraw or amend, in full or in part, your processing consent given previously, in each case subject to any applicable legal restrictions, contractual conditions and a reasonable time period in person at our corporate offices located at the address given in C above.

E. Consequences of Refusal / Failure to Provide Personal Data

The Personal Data provided to us are wholly voluntary in nature and you are not under any obligation or under any duress to do so. However, in some circumstances such as the preparation and execution of a Sales and Purchase Contract, or a Supplier Letter of Award or an Employment Letter requires certain personal details and information beforehand.

The failure to provide the Personal Data may result in the following which we shall not be held liable for any of the consequences arising therefrom:

the inability of parties to formalize any contract and/or agreement and/or Sale and Purchase Agreement / tenders / Letter of Awards / Employment Contract in relation to the sale of our property, products and/or services, to facilitate construction or to hire human resource;
the inability for us to provide you with the notices, services and/or products requested;
the inability for us to update you with the latest product and/or launches;
the inability to complete commercial transactions in relation to our projects, products and/or services; and
the inability to comply with any applicable law, regulation, direction, court order, by laws, guidelines and/or codes applicable to us.

F. Safety of Personal Data

The Company uses a number of mechanisms to protect the security and integrity of your Personal Data.
For the internet, unfortunately, no data transmission over the internet can be guaranteed as completely secure. So while the Company strives to protect such Personal Data, the Company cannot ensure or warrant the security of any Personal Data transmitted to the Company and individuals do so at their own risk. Once any Personal Data comes into the Company’s possession, the Company will take reasonable steps to protect that information from misuse and loss and from unauthorised access, modification or disclosure.

G. Transfer of Personal Data

Due to the global nature of the Company’s business, the Company may transfer your Personal Data to the other members of the Company (which may be located in other countries) or to any parties located in other countries (including countries that have a different data protection regime than is found in the country where you are based). Any Personal Data transferred shall be used for the purposes as set out in (B) above and disclosed to parties stated in (C) above.

By activating a link, such as for example by clicking on the banner of an advertiser, you leave the Company’s Website and the Company does not exercise control over any Personal Data or any other information you give to any other entity after you have left the Company’s Website.

I. IP Addresses and Cookies

Angkasa Bumijaya also collects Internet Protocol (IP) addresses. IP addresses are assigned to computers on the internet to uniquely identify them within the global network. Angkasa Bumijaya collects and manages IP addresses as part of the service of providing internet session management and for security purposes.

Angkasa Bumijaya’s websites may transmit to any customer’s computer a “cookie”. A cookie is a package of data that allows Angkasa Bumijaya’s server to identify and interact more effectively with the customer’s computer having to spend time on identifying each customer user, thereby also providing additional login convenience. You may configure and personalize its current browser to refuse, reject or delete such cookies.

J. Links

Interest Based Advertising is a way of making advertisements more relevant to the customer based on Personal Information provided by the customer. In order to provide the customer with Interest Based Advertising, Angkasa Bumijaya may collect information about a customer’s activities and use that information to associate the customer’s with one or more pre-defined interest categories. Angkasa Bumijaya may periodically provide you advertisements that are tailored to your interests.
